General Terms and Conditions

Our details are: STVV NV, Tiensesteenweg 168, 3800 Sint-Truiden, with company number 0845.049.251 (hereinafter "STVV", "we" or "us").

1. Application

These terms and conditions apply when you use our websites, mobile applications, webshops, ticket shops, wireless (wifi, bluetooth) networks, software, membership and cashless payment cards and other online products and services ("Online Services").

By using our Online Services, you agree to these terms and conditions and undertake to comply with and accept these terms and conditions. If you are a minor, you should read this agreement together with your parent(s) or guardian and seek their agreement to accept these terms and conditions.

 

2. Your Personal Account

You alone (and to the exclusion of STVV) are responsible for maintaining the confidentiality and security of your personal account and for all activities that take place through your personal account. You may not disclose your personal account to third parties. Its use is strictly personal. In the event of a breach of the security or confidentiality of your personal account, you must inform STVV of the breach as quickly and accurately as possible. STVV is not responsible under any circumstances for unauthorized or unwanted use of your personal account by yourself or a third party.

 

3. Use of Online Services

You undertake not to use the Online Services:

(a) for your own commercial purposes or for the commercial purposes of third parties. The use of the Online Services is limited to exclusively personal purposes.

(b) to submit, transmit, post, store or otherwise make available through the Online Services any unlawful, false, misleading, stolen, knowingly false or otherwise unlawful content or information;

(c) to submit, transmit, post or otherwise make available content or information that is unlawful, abusive, threatening, racist, hateful, libelous, defamatory, vulgar, offensive or harmful to STVV and/or third parties (including other users);

(d) not to unduly or unlawfully burden, impede or otherwise interfere with the operation of the Online Services or any associated services, products, software, networking, access and other products and services.

 

4. Use of Your Data.

By using our Online Services, such as for example by (but not limited to) posting materials such as texts, photos and videos, you grant STVV and its partners and suppliers the non-exclusive, worldwide, perpetual and free permission to (re)produce, distribute, publicly communicate, edit, delete, synchronize with other information and data and otherwise use your information and data.

 

5. Third Party Information

The Online Services may contain information and data from third parties, such as information from sponsors, partners and suppliers and other users, including links and other references to third-party websites, social media and other online services. However, STVV does not control, and STVV is not obliged to control, the content of the websites, social media and other online services of third parties and in no case can STVV be held liable or responsible for the content of the websites, social media and other online services of third parties. Furthermore, the reference to or inclusion of third-party information and data does not imply that STVV agrees with such content.

 

6. Intellectual Property

Our Online Services may contain information, data, images, works, texts, video material, databases, brands, trade names, domain names and other materials and data belonging to STVV and third parties which are protected by (intellectual) property rights. You acknowledge these rights and undertake not to use these materials and data in a way which infringes the aforementioned rights of STVV or third parties.

If you send, place, publish, communicate or in any other way use information, data, images, works, data, texts, video material and other materials and data on or via the Online Services, you undertake and guarantee that you have the necessary rights or have obtained permission from the owner(s).

 

7. Privacy

STVV's privacy policy applies to the Online Services. You can find our Privacy Policy on our website, in the same location as these General Terms and Conditions.

 

8. Limitation of liability

The Online Services (including all products and services provided via the Online Services) are always provided by STVV "as is". STVV only has a best-efforts obligation in this regard. The Online Services are used at your own risk and STVV does not provide any guarantees or results in this regard, either explicitly or implicitly. Only in jurisdictions where the exclusion or limitation of a guarantee cannot be invoked will that particular guarantee not be excluded or limited and STVV's guarantee will be excluded or limited to the minimum obligation imposed by the applicable law.

STVV cannot guarantee that the Online Services, in whole or in part, temporarily or permanently, will be without defects and cannot be held responsible or liable for any errors, defects, incompleteness, inaccuracies or other imperfections of the Online Services. STVV may also not be obliged to make any repairs to the Online Services or any part thereof.

STVV will not be held liable for any direct, indirect, incidental, punitive and/or consequential damage resulting from the use or impossibility of use of the Online Services including all products and services provided via the Online Services. Only in jurisdictions where an exclusion or limitation of liability for consequential or incidental damages cannot be invoked will STVV's liability be limited to the maximum exclusion as permitted by law.

Termination of the Online Services

STVV has the right to suspend, delete, discontinue, limit or modify all or part of the Online Services at any time in relation to one, several or all users. STVV may decide to do so without notice or reason. You cannot hold STVV responsible or liable in any way for such a decision.

 

9. Termination of this agreement

STVV has the right to terminate this agreement at any time without notice or reason, including the right to close your personal account, without STVV being held liable in any way for any consequence thereof.

 

10. Amendments

STVV has the right to unilaterally amend these general terms and conditions and agreement at any time. Each time you use the Online Services, the latest version will apply. You should check this page regularly.

 

11. Miscellaneous provisions

Failure or delay by you or us in exercising any right under these terms and conditions will not be considered a waiver of that right. Such failure or delay shall not affect any other events or rights.

If any clause in these terms and conditions should be or become invalid or unenforceable by any court of competent jurisdiction, such invalidity or unenforceability shall in no way affect the validity or enforceability of any other clause, in whole or in part.

No person who is not a party to these Terms and Conditions shall thereby acquire any rights or assert any rights in respect of any provision of these Terms and Conditions, even if such person relies on such provision or has indicated to either party its agreement with any provision of these Terms and Conditions.

A printed version of these Terms and Conditions, the Privacy Policy and the Online sales conditions and of any warning and notice delivered under electronic form, will be accepted in any judicial or administrative proceedings arising out of or in connection with these Terms and Conditions, the Privacy Policy and the Online sales conditions, in the same manner and under the same conditions as other documents and commercial registers created and kept in printed form. All rights not expressly ceded in this document are reserved.

All agreements to which these general terms and conditions apply are governed by Belgian law. The courts at STVV's registered office have sole jurisdiction for any disputes which may arise in connection with these general conditions.
